EVENT TRANSPORTATION SERVICE AGREEMENT

This Event Transportation Service Agreement (“Agreement”) establishes the terms and conditions applicable to the purchase and use of transportation services provided by Phoenix Bus Inc. (“Phoenix Bus,” “Company,” “we,” “us,” or “our”), located at 3220 37th Street, Orlando, FL 32839.

By purchasing a transportation ticket, making a reservation, accepting these terms during checkout, signing this Agreement electronically or physically, boarding a Phoenix Bus Inc. vehicle, or otherwise participating in the transportation service, the purchaser and passenger (“Passenger” or “Guest”) acknowledges and agrees to the terms below.

1. NATURE OF SERVICES

Phoenix Bus Inc. provides passenger transportation services in connection with concerts, sporting events, festivals, entertainment events, corporate events, special events, and other group transportation activities.

Services may include:

Round-trip event transportation

One-way transportation

Shuttle transportation

Group transportation

Charter transportation

Dedicated event transportation

Transportation between designated pickup locations and event venues

Transportation between Orlando and other Florida destinations

Transportation coordination and event logistics

Unless expressly stated otherwise, Phoenix Bus Inc. transportation is limited to the transportation service described in the applicable reservation, ticket, confirmation, or promotional materials.

A transportation reservation does not constitute a ticket or guarantee of admission to the event or venue unless expressly stated otherwise.

2. EVENT TICKETS ARE SEPARATE

Unless specifically included in the purchase, Phoenix Bus Inc. does not sell, provide, guarantee, or control admission tickets to the event or venue.

The Passenger is solely responsible for obtaining a valid event ticket and complying with all event and venue requirements.

Phoenix Bus Inc. is not responsible for a Passenger's inability to enter an event because of:

Failure to purchase an event ticket

Invalid or counterfeit tickets

Incorrect identification

Age restrictions

Venue policies

Security requirements

Prohibited items

Dress codes

Late arrival

Removal from the venue

Any other venue or event admission requirement

A Phoenix Bus Inc. transportation reservation remains separate from the event admission process.

3. TRANSPORTATION SERVICES

Phoenix Bus Inc. may provide transportation using motor coaches, charter buses, shuttle buses, vans, school buses, or other appropriate passenger vehicles based on the requirements of the event.

Phoenix Bus Inc. will make reasonable efforts to provide the vehicle type, capacity, amenities, and service described in the applicable reservation or promotional materials.

However, no specific vehicle is guaranteed unless expressly confirmed in writing by Phoenix Bus Inc..

Phoenix Bus may substitute a vehicle when reasonably necessary because of operational, maintenance, safety, availability, or scheduling considerations.

Any replacement vehicle will be reasonably suitable for the transportation service whenever practicable.

4. PASSENGER RESPONSIBILITIES

Passengers are responsible for:

Arriving at the designated pickup location on time

Having the required reservation or ticket information

Following driver and Company instructions

Remaining seated when appropriate

Using available seat belts where required or provided

Boarding and exiting the vehicle safely

Maintaining appropriate conduct

Respecting other passengers

Protecting their personal belongings

Complying with applicable laws and transportation rules

Passengers must not interfere with the driver or otherwise create a safety risk.

5. PICKUP AND DEPARTURE TIMES

Passengers must arrive at the designated pickup location before the published departure time.

Phoenix Bus Inc. may depart at the scheduled time regardless of whether an individual Passenger has arrived.

The scheduled departure time is not the time at which passengers should arrive.

Passengers should allow sufficient time for parking, traffic, walking to the pickup location, checking in, and boarding.

A Passenger who misses the scheduled departure is responsible for arranging and paying for any alternative transportation.

Phoenix Bus Inc. is not required to delay the vehicle for passengers who arrive after the scheduled departure time.

6. RETURN TRANSPORTATION

For round-trip event transportation, Phoenix Bus Inc. will establish a designated return departure time and/or meeting location.

Passengers are responsible for being at the designated return location before the scheduled departure time.

Phoenix Bus Inc. may depart at the scheduled return time even if a Passenger has not arrived.

Passengers who voluntarily remain at the event after the scheduled return departure are responsible for arranging and paying for their own transportation back.

Phoenix Bus Inc. does not guarantee that a Passenger who misses the scheduled return departure will receive alternative transportation.

7. TRANSPORTATION RISKS

Passenger understands that transportation by motor vehicle involves inherent risks that cannot be completely eliminated.

Such risks may include:

Traffic accidents

Sudden braking

Sudden acceleration

Sharp turns

Traffic congestion

Road conditions

Weather conditions

Mechanical problems

Vehicle malfunction

Actions of other motorists

Delays

Road closures

Construction

Police activity

Boarding and exiting the vehicle

Slips, trips, and falls

Movement inside the vehicle

Personal injury

Property damage

Changes to pickup or drop-off locations.

Passengers voluntarily participate in the transportation service with knowledge that these ordinary transportation risks exist.

8. SAFETY AND DRIVER AUTHORITY

The safety of passengers is Phoenix Bus Inc's primary operational consideration.

Passengers must follow reasonable instructions provided by the driver or Phoenix Bus personnel.

The driver has authority to take reasonable actions necessary to operate the vehicle safely and comply with applicable transportation laws and regulations.

Passengers may not:

Distract the driver

Enter the driver's area without authorization

Block aisles or emergency exits

Tamper with safety equipment

Engage in violent or threatening behavior

Damage the vehicle

Engage in conduct that creates a safety hazard.

Phoenix Bus Inc. may refuse or discontinue transportation when permitted by law if a Passenger creates a material safety risk.

9. ALCOHOL AND INTOXICATION

Alcohol consumption may be permitted only when lawful and when consistent with Phoenix Bus Inc. policies, applicable law, and the requirements of the specific transportation service.

Passengers may not consume alcohol if doing so is prohibited by law, the vehicle's operating rules, the applicable event requirements, or Phoenix Bus policy.

Passengers must not become dangerously intoxicated or engage in disruptive, threatening, violent, or unsafe conduct.

Phoenix Bus Inc. may refuse or discontinue transportation for a Passenger whose conduct creates a material safety risk.

A Passenger removed from transportation because of their own conduct may be responsible for arranging and paying for alternative transportation.

Under no circumstances may a Passenger operate a motor vehicle while impaired.

10. PROHIBITED ITEMS AND ILLEGAL ACTIVITY

Passengers must comply with all applicable federal, state, and local laws.

The following are prohibited to the extent applicable:

Illegal drugs

Unlawfully possessed weapons

Explosives

Hazardous materials

Other items prohibited by law or Phoenix Bus Inc. policy.

Phoenix Bus Inc. may refuse transportation to a Passenger possessing prohibited items where permitted by law.

Phoenix Bus Inc. is not responsible for legal consequences resulting from a Passenger's unlawful conduct.

11. PERSONAL PROPERTY

Passengers are responsible for their personal belongings, including:

Phones

Wallets

Identification

Bags

Cameras

Clothing

Luggage

Electronic devices

Other personal property.

Passengers should verify that they have all personal belongings before leaving the vehicle.

To the fullest extent permitted by applicable law, Phoenix Bus Inc. is not responsible for property that is lost, misplaced, forgotten, stolen, or damaged, except to the extent liability cannot legally be excluded.

Lost-and-found items recovered by Phoenix Bus Inc. may be handled according to the Company's applicable lost-and-found procedures.

12. DELAYS AND TRAFFIC

Phoenix Bus Inc. does not guarantee exact arrival or return times.

Event transportation is subject to conditions that may affect travel time, including:

Traffic congestion

Accidents

Weather

Road construction

Road closures

Police activity

Government action

Event traffic

Parking restrictions

Venue operations

Mechanical issues

Other circumstances outside the Company's reasonable control.

Passengers acknowledge that event transportation may require additional travel time because of unusually heavy traffic surrounding major concerts, sporting events, festivals, and other large gatherings.

13. CHANGES TO ROUTES, PICKUP LOCATIONS AND SCHEDULES

Phoenix Bus Inc. may reasonably modify:

Pickup locations

Pickup times

Departure times

Routes

Drop-off locations

Return departure locations

Vehicle assignments

Transportation procedures.

when necessary because of traffic, safety, venue requirements, law enforcement, road closures, vehicle availability, weather, mechanical conditions, or other circumstances beyond the Company's reasonable control.

Phoenix Bus Inc. will make reasonable efforts to communicate material changes to passengers using the contact information provided during the reservation process.

14. EVENT CANCELLATION OR CHANGE

Phoenix Bus Inc's transportation service is separate from the event itself.

If an event is postponed, rescheduled, relocated, shortened, or cancelled, the transportation reservation will be handled according to Phoenix Bus Inc's applicable cancellation and refund policy and any event-specific terms communicated to the Passenger.

Phoenix Bus Inc. does not control the decisions of concert promoters, performers, stadiums, venues, event organizers, ticketing companies, or other third parties.

15. CANCELLATIONS AND REFUNDS

Transportation reservations are subject to the cancellation and refund terms presented to the Passenger at the time of purchase or reservation.

Unless otherwise expressly stated in writing, the following circumstances do not automatically create a right to a refund:

Passenger changes their plans

Passenger does not attend the event

Passenger arrives late

Passenger misses the departure

Passenger misses the return transportation

Passenger chooses not to use the transportation

Passenger is denied admission to the event

Passenger is removed from the event

Passenger is removed from transportation because of misconduct.

Nothing in this Agreement is intended to waive any refund or consumer right that cannot legally be waived.

16. PASSENGER CONDUCT

Phoenix Bus Inc. expects all passengers to behave respectfully and safely.

Phoenix Bus inc. may refuse or discontinue transportation, to the extent permitted by law, when a Passenger:

Threatens another person

Engages in violence

Harasses another passenger

Damages the vehicle

Creates a safety hazard

Refuses reasonable safety instructions

Engages in unlawful conduct

Is dangerously intoxicated

Interferes with the driver's duties

Creates a material disruption to the transportation service

No refund is necessarily due when transportation is discontinued because of a Passenger's own misconduct.

17. DAMAGE TO VEHICLE

A Passenger may be financially responsible for reasonable and documented costs resulting from intentional, reckless, or negligent damage caused by that Passenger to a Phoenix Bus Inc. vehicle or other Company property, to the extent permitted by law.

This may include extraordinary cleaning or repair costs directly resulting from the Passenger's conduct.

17.1 EXCESSIVE CLEANING AND SANITATION FEE

The Passenger acknowledges that they are responsible for maintaining the cleanliness and sanitary condition of the vehicle during the transportation service. If a Passenger causes excessive cleaning, sanitation, deodorization, or restoration to the vehicle as a result of vomit, urine, feces, beverages, food, bodily fluids, or any other substance or material, the responsible Passenger may be charged an Excessive Cleaning and Sanitation Fee ranging from $450 to $650, depending on the extent and severity of the cleaning required. This fee is intended to cover reasonable costs associated with professional cleaning, sanitation, deodorization, labor, materials, and, when applicable, temporary removal of the vehicle from service. By purchasing a ticket or boarding the vehicle, the Passenger authorizes Phoenix Bus Inc. to charge the applicable fee to the payment method used for the reservation, where permitted by law.

18. ASSUMPTION OF RISK

To the fullest extent permitted by applicable law, Passenger acknowledges and voluntarily assumes the ordinary and inherent risks associated with participation in transportation services, including the ordinary risks of motor vehicle travel, boarding and exiting vehicles, traffic, weather, road conditions, and interactions with other passengers and third parties.

Nothing in this Agreement releases any liability that cannot legally be released or waived under applicable law.

19. RELEASE OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PASSENGER AGREES TO RELEASE PHOENIX BUS INC., ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, DRIVERS, AGENTS, REPRESENTATIVES, AND CONTRACTORS FROM CLAIMS ARISING FROM THE ORDINARY AND INHERENT RISKS OF PARTICIPATING IN THE TRANSPORTATION SERVICE, INCLUDING ORDINARY NEGLIGENCE, TO THE EXTENT SUCH CLAIMS MAY LAWFULLY BE RELEASED.

This provision does not release liability for conduct or circumstances that cannot legally be released or waived under applicable law.

20. INDEPENDENT THIRD-PARTY SERVICES

When Phoenix Bus inc. engages an independently owned or operated transportation provider, vendor, venue, parking facility, event organizer, or other third party, that third party may remain responsible for matters within its own control.

Nothing in this Agreement is intended to eliminate any responsibility imposed by applicable law.

21. MEDICAL CONDITIONS AND EMERGENCIES

Each Passenger is responsible for determining whether they are physically able to participate in the transportation service.

Passengers with medical conditions, allergies, mobility limitations, or other circumstances requiring accommodation should notify Phoenix Bus Inc.in advance and make appropriate arrangements.

Phoenix Bus inc. is not a medical provider and does not undertake responsibility for diagnosing, monitoring, or treating a Passenger's medical condition.

Emergency medical services may be contacted when reasonably appropriate.

Medical expenses incurred by a Passenger remain the Passenger's responsibility except where another party is legally responsible.

22. FORCE MAJEURE

To the fullest extent permitted by applicable law, Phoenix Bus inc. will not be responsible for delays, modifications, cancellations, or inability to perform caused by circumstances outside the Company's reasonable control, including:

Severe weather

Natural disasters

Traffic emergencies

Major accidents

Road closures

Government action

Police activity

Public emergencies

Venue closures

Mechanical failures

Transportation-provider failures

Labor disruptions

Acts of God

Other circumstances beyond the Company's reasonable control.

Phoenix Bus will make reasonable efforts to provide notice and alternative arrangements when reasonably practicable.

23. NO GUARANTEE OF EVENT EXPERIENCE

Phoenix Bus Inc. provides transportation and does not control the event, performer, venue, promoter, ticketing company, security company, or other event-related third parties.

Phoenix Bus Inc. does not guarantee:

Event performance

Performer appearance

Event duration

Event quality

Venue admission

Venue policies

Event schedule

Event seating

Event cancellation or postponement

Actions of other attendees

Event-related entertainment.

The Passenger's transportation reservation is for transportation services only unless expressly stated otherwise.

24. PHOTOGRAPHY AND VIDEO

Phoenix Bus inc. or its event partners may photograph or record transportation activities, events, groups, or passengers for documentation, marketing, or promotional purposes where permitted by applicable law.

Where a separate written consent or media release is legally required for a specific use of an identifiable Passenger's image, Phoenix Bus will obtain such consent through the applicable process.

25. ELECTRONIC COMMUNICATIONS

Passengers agree that Phoenix Bus inc. may communicate important transportation information electronically using the contact information provided during the reservation process.

Communications may include:

Pickup instructions

Schedule updates

Location changes

Traffic-related updates

Emergency notifications

Cancellation information

Return transportation instructions.

Passengers are responsible for providing accurate contact information and monitoring communications related to their reservation.

26. ELECTRONIC ACCEPTANCE

This Agreement may be accepted electronically.

An electronic checkbox, electronic signature, online purchase, reservation confirmation, or other affirmative electronic action indicating acceptance may constitute acceptance of this Agreement where permitted by applicable law.

By completing a reservation or boarding transportation after being provided access to these terms, Passenger acknowledges that they have had an opportunity to review the Agreement and voluntarily agree to its terms.

27. PURCHASES FOR OTHER PASSENGERS

A person purchasing multiple transportation tickets or reservations is responsible for making these terms available to the other passengers included in the reservation.

Phoenix Bus Inc. may require individual passengers to acknowledge these terms where appropriate.

The purchaser represents that they have authority to provide the applicable reservation information to the passengers included in the purchase.

28. GOVERNING LAW

This Agreement shall be interpreted in accordance with the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.

To the extent permitted by applicable law, disputes concerning this Agreement shall be brought in an appropriate court of competent jurisdiction in Florida.

29. SEVERABILITY

If any provision of this Agreement is determined to be invalid or unenforceable, that provision shall be limited or modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

30. NO WAIVER

Failure by Phoenix Bus Inc. to enforce any provision of this Agreement on one occasion does not constitute a waiver of its right to enforce that provision in the future.

31. ENTIRE AGREEMENT

This Agreement, together with the applicable reservation confirmation, purchase terms, cancellation policy, and other written terms specifically incorporated into the transportation purchase, constitutes the agreement between Phoenix Bus inc. and the Passenger regarding the applicable transportation service.

If an event-specific transportation policy conflicts with this Agreement, the event-specific policy may control to the extent expressly stated.

PASSENGER ACKNOWLEDGMENT

BY PURCHASING A TRANSPORTATION TICKET, MAKING A RESERVATION, ACCEPTING THESE TERMS ELECTRONICALLY, OR BOARDING PHOENIX BUS TRANSPORTATION, THE PASSENGER ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND AGREED TO THIS EVENT TRANSPORTATION SERVICE AGREEMENT.

THE PASSENGER ACKNOWLEDGES THE RISKS ASSOCIATED WITH MOTOR VEHICLE TRANSPORTATION AND VOLUNTARILY AGREES TO THE TERMS OF THIS AGREEMENT, INCLUDING THE RELEASE OF CLAIMS TO THE FULLEST EXTENT PERMITTED BY LAW.
